    It appears to be a different company. That Smart Company article from 2008 refers to Commander Communications, which went down. The company now trading under the name “Commander” is (according to the footer of their website) M2 Commander Pty Ltd. They’re part of M2 Telecommunications Group Ltd.

    There’s nothing sinister here. Commander Communications went bust, so their assets were sold off to pay debts — or what debts could be paid. One asset would have been the trading name “Commander”. Another, the trademarks associated with it, such as the logo. There’d also be whatever “goodwill” items that could be sold off, such as the value of existing customer contracts.

    If the value of those assets didn’t cover the debts owed, then the creditors just get a proportion of their money and that’s the end of it. Commander Communications is dead and as much has been picked from the carcase as can be had. That’s how folding a company or bankruptcy works.

    Of course there are questions about how Commander Communications ended up so far in the red that it went down so badly. But none of that relates to the new business, M2 Commander, which is a completely different legal entity dressed in the clothes of the dead entity.

    That said, I haven’t looked to see whether this new company shares any directors with the old one.

    We were one of those engaged for work by Commander right at the end. Job done, business goes under, no payment. They were still buying things right to the end. :(

    Alas, that’s how it goes, Drazen. Which is why over the years there’s been a steady push to make company directors personally responsible in a wider range of circumstance. Sorry to hear you got burned.
